Terms of Use

These terms are an agreement between you and GtaHomeSearch Inc. ("we" or "us"), which runs GTA Home Search at gtahomesearch.ca. By using the site you accept them. If you don't accept them, please don't use the site.

1. What this site is

GTA Home Search is an advertising site for new construction and rentals in the Greater Toronto Area and surrounding cities.

• Builders advertise their own projects, and landlords advertise their own rentals.
• We don't show listings from MLS® or any real estate board, and we aren't affiliated with any real estate board or brokerage.
• We aren't a party to any sale or rental. We don't act for buyers, tenants, builders or landlords, negotiate on anyone's behalf, handle deposits or give advice.
• Anything you agree with an advertiser is between you and them.

2. Information on the site

Advertisers' listings. Advertisers write their own listings and are responsible for them. We review listings before they go live, but we don't verify every detail and don't guarantee they're accurate.

Researched project pages. Some new construction pages are researched by us from builders' websites and other public sources. They're labelled as researched, show their source and the date we last checked, and may be out of date or wrong. They aren't advertising by the builder, and the builder hasn't reviewed them. Builders can ask us to correct or remove them.

Illustrations. Pictures marked "Illustration only" are drawings of a type of home, not the actual property. Map locations can be approximate.

Always confirm details with the advertiser, see a home in person, and get independent advice before signing or paying anything. Never send money to someone you haven't verified.

3. Who can advertise

To create an account, you must be at least 18 and able to enter a binding contract. Only these advertisers are allowed:

• Rentals: a landlord or apartment building owner who owns the rental, or a person authorized by the owner who isn't a real estate agent.
• New construction: a builder or vendor of the project, or its own staff, holding the licences Ontario requires.

Real estate agents, brokers and brokerages can't advertise here, and nobody can post on their behalf. You're responsible for your account and password, and the information you give us must be accurate.

4. Rules for listings

You confirm that each listing is real, accurate and available, and that you're allowed to advertise it. You must follow all laws that apply to you, including those below.

• Not listed on MLS®. Don't post a property that's listed on MLS®.
• No discrimination. Follow the Ontario Human Rights Code. Don't exclude or discourage people because of a protected ground, such as family status or receiving public assistance. Wording such as "no children", "adults only", "students only" or "no ODSP" isn't allowed.
• Lawful rental terms. Follow Ontario's Residential Tenancies Act, 2006. Don't ask for deposits or fees the law doesn't allow, such as damage or pet deposits.
• Honest pricing. Show prices that include all mandatory fees, and don't mislead anyone. This includes the rules in the Competition Act.
• Licensing. Builders and vendors must hold the licences required under the New Home Construction Licensing Act, 2017, and give us an accurate licence number.
• Your content. Only upload photos, floor plans and text you have the right to use. Don't include anyone's private information without their permission.
• No misuse. Don't post scams, spam or anything illegal, and don't copy or scrape the site, disrupt it, or contact advertisers to sell them things.

5. Fees

All prices are in Canadian dollars. We show the amount you'll pay at checkout, before you pay it, including any taxes that apply.

• Listing periods: rental listings run for 30 days, and new construction listings run for 90 days and include photos, floor plans and direct inquiries.
• Free listings: each account gets free listings for the same periods: 1 for a landlord renting out a home, 3 for the owner of an apartment building, and 1 for a builder. Choose your account type honestly, and don't open extra accounts to get more. We can charge for or remove listings that break this rule.

All fees are final and non-refundable. See our Refund Policy.

The listing period starts when we approve the listing, not when you pay. Listings don't renew automatically, and you won't be charged again unless you choose to relist. Stripe processes card payments, and we never see or store your full card number.

6. Review and removal

We can review, decline, edit for formatting, or remove any listing, and suspend or close an account, if we reasonably believe it breaks these terms or the law, or puts people at risk. If you edit a live listing, it goes back to review and doesn't show until it's approved again. Its end date doesn't change.

7. Your content

You keep ownership of what you post. You give us a non-exclusive, royalty-free licence to display, copy and format it on the site and in promoting the site, for as long as it's listed and for a reasonable time after that to clear it from backups.

The site's design, text and logo belong to us or our licensors. If you believe something on the site infringes your copyright or is wrong, contact us using the details below.

8. Contact between visitors and advertisers

Inquiries go straight to the advertiser by email, and we don't keep a copy. We don't check messages or who sends them. Be careful what you share.

9. Disclaimers

The site is provided as is. We don't promise it will always be available or free of errors, or that any listing or advertiser is accurate, licensed or reliable. Nothing on the site is legal, financial or real estate advice.

10. Limit on our responsibility

To the extent the law allows, we aren't responsible for indirect or consequential losses, or for losses arising from dealings between you and another user. Our total responsibility for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and $100.

Nothing in these terms removes rights you have under consumer protection law that can't legally be waived.

11. Your responsibility to us

If you advertise on the site and a third party makes a claim against us because of your listing, your content or your breaking these terms, you agree to cover our reasonable losses and costs. This doesn't apply to the extent we caused the loss, or where the law doesn't allow it.

12. Closing your account

You can delete your account at any time from your account page. That removes your listings, and fees already paid aren't refunded.

13. Changes to these terms

We may update these terms. We'll change the date above, and tell account holders by email about significant changes. Changes don't apply to listing periods you've already paid for unless the law requires it.

14. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario, unless consumer protection law gives you a different right.
